Frequently asked questions

How will our assets be divided?

It is important to remember that the reasons for your divorce will have no impact on the financial split that a Court may make. The starting point for the Court is to bring about a fair division of matrimonial assets taking into account the means of the husband and wife, but most importantly, the welfare of any children of the marriage under 18. We will be able to advise you further in this respect during our free initial consultation appointment.

Will I have to go to Court?

It is very rare that the parties have to attend Court in Divorce Proceedings. However if you and your ex-partner cannot agree a fair and reasonable financial settlement between you then you may need the assistance of the Court in this respect. If so, then there will be Court hearings to attend.

Will we have to sell the family home?

Whether or not you have to sell the family home will depend on the facts personal to your situation and the extent of the overall matrimonial finances. However this option can be discussed in more detail during a free initial consultation.

How long does it take to get divorced?

At Pearcelegal we issue all new Divorce Petitions online. This is a much speedier process than having to rely on paperwork and post. However the length of time it will take to get divorced will depend on various factors, such as whether or not both parties consent to the divorce. We would also strongly recommend that your divorce is not finalised until an agreement has been reached in respect of the matrimonial finances.

What do family law solicitors do?

Family relationships are often complicated. Emotional pain, family disagreements, and conflicts may sometimes result in divorce. The divorce proceedings may sometimes be very stressful and disastrous for the family. If you find yourself in this situation, you will need the assistance of family law solicitors. Solicitors in Solihull will help you to deal with such cases in the best possible way so that you can live in peace again.

Children

When a couple that's been together for years decides to get divorced, the decision will also affect the children from the marriage greatly. Therefore, you may need the assistance of solicitors in Solihull to deal with the situation in a more peaceful manner so that children will not feel the stress of being separated from one parent.

A family law attorney will work with discretion and compassion to achieve the best possible result for your children's well-being. If you need to file for a joint residence order, a communication order, or a prohibited steps order, your lawyer can walk you through the process and help you make the best decision possible.

Cohabitation

You will not automatically be entitled to your fair share of assets if you and your wife are not married. Cohabitation arrangements will guarantee that you have a legal right to a share of jointly funded assets if your partnership ends.

Collaborative approaches

You and your partner can decide that talking about your issues face to face is the best way to work through them. With the assistance of your family law solicitor, you will set the agenda for meetings and lead discussions. If efforts to negotiate an agreement fail, your legal counsel will represent your legal rights.

Divorce Proceeding

The legal dynamics of divorce can be perplexing and confusing. You will manage the process more efficiently and reach a result that is beneficial to your future if you have a family law attorney representing your interests. Your attorney will be there to help you through each phase of the legal process, whether you are protecting your claim to a fair share of assets or battling for custody of your children.

Domestic Violence

Though domestic abuse is uncommon in the United Kingdom, thousands of people live in constant fear of being assaulted or intimidated. No one should be forced to live in this manner, which is why hiring accomplished family law solicitors in Solihull is critical. Your attorney will not only lend you a sympathetic ear but will also ensure that you are able to take the appropriate action required to protect yourself and your family.

Family Mediator

If you're having problems in your marriage or are already divorced, you may not be able to take the final step of filing for divorce. Family mediation sessions should be arranged and presided over by a trusted and professional family law solicitor, who can provide a structured environment for the airing of disputes and the quest for resolution. They can handle prenuptial arrangements, grandparents' rights, and any other disputes that could end up in court.

In the United Kingdom, the legal structure for family law is complex and extensive. You can only be confident that your interests are being effectively served if you have the specialist assistance of a family law solicitor at your disposal.

What are the legal reasons for divorce?

For one to file for divorce there are a few things you must provide as proof that your marriage has broken and the only option that is there is for you to separate by having a divorce. Some of the reasons that can allow you to file for divorce are as follows:

  • If you have caught your husband or wife cheating on you or your partner has confessed or admitted to have cheated on you.
  • When your partner has abandoned or betrayed you for a period of not less than two years.
  • When you have been apart for at least two years, and there is a mutual feeling of getting divorced
  • When you and your partner have been apart for at least 5 years, you can get a divorce and this can happen even if your partner doesn't consent to the divorce.
  • There are times where you have been married for a short period of time, a marriage of fewer than two years. Here you can get a divorce on the grounds of unfair conduct, adultery, or desertion.

What are my options for seeing the kids, after divorce?

While divorce is often difficult for the children, they are normally given visitation rights.

This ensures that contact between parents and children will continue. The Court may order this contact with the children if it does not appear to be a threat to the children's safety.

When it comes to contact, you have the choice of directly negotiating with your children or enlisting the help of mediators. If this doesn't work and you still can't come to an agreement, you can file an appeal with the court if you've attended a MIAM (Mediation Information and Assessment Meeting).
